EB-3 Unskilled Worker Program
The EB-3 Unskilled Worker Program is part of the Immigration and Nationality Act (the Act), which was amended in 1990. This program allows up to 10,000 individuals worldwide to obtain a green card, granting them the right to live and work permanently in the United States. Opportunity in the U.S. Labor Market
The U.S. labor market faces significant workforce shortages. According to the U.S. Chamber of Commerce, even if every unemployed person in the country secured a job, there would still be over 4 million unfilled positions. This demand creates an excellent opportunity for qualified individuals to immigrate and work in the U.S. as permanent residents.
The EB-3 Application Process
The process consists of four key steps:
Step 1: Prevailing Wage Determination (PWD) & PERM Labor Certification
Once an employer signs a contract with American Job Network, our legal partners files a Prevailing Wage Determination (PWD) request with the National Prevailing Wage Center (NPWC). The PWD establishes the appropriate wage for the job based on the job title, work responsibilities, wage rate, and location.
After receiving the PWD, the employer files for Permanent Employment Certification (PERM), also known as a labor certificate (LC). This certification verifies that no qualified U.S. workers are available for the position. The PERM approval timeline varies, and additional time may be required if selected for an audit.
Step 2: Immigrant Petition for Alien Workers (I-140 Filing)
Once the PERM is approved, the employer submits Form I-140 (Immigrant Petition for Alien Workers) to the U.S. Citizenship and Immigration Services (USCIS). Applicants can expedite the processing of I-140 by paying a premium processing fee of $2,500, in addition to the standard filing fee.
Step 3: Visa Processing or Adjustment of Status
For applicants outside the U.S.: Once the I-140 petition is approved, applicants must submit Form DS-260 (Application for Immigrant Visa and Alien Registration) for consular processing. The National Visa Center (NVC) processes the application and forwards it to the U.S. Embassy in the applicant’s home country. The applicant is then scheduled for an interview at the embassy. Upon approval, an EW-3 immigrant visa is issued, allowing the applicant to enter the U.S. as a permanent resident.
For applicants already in the U.S.: Those holding a valid non-immigrant visa can concurrently file Form I-485 (Application to Register Permanent Residence or Adjust Status) along with Form I-140 and Form I-765 (Employment Authorization). Adjustment of Status (AOS) applicants are rarely required to attend an interview, which often results in a faster processing timeline.
Step 4: Arrival and Employment in the U.S.
Upon arrival in the U.S., the applicant must begin employment with the sponsoring employer as soon as possible. As per the contract, the employee must work for the sponsoring employer for at least one year; failure to comply may result in the revocation of the green card.
Family Eligibility for EB-3 Visa Holders
If the principal applicant’s I-140 petition is approved, their spouse and unmarried children under 21 years of age may also apply for admission to the U.S. under the following classifications:
EW-4: Spouse of an EB-3 unskilled worker
EW-5: Child of an EB-3 unskilled worker
